Spousal Benefit

There are various ways in which the spouses can financially favor each other in a marriage and inheritance contract in the event of death.

 

If one spouse dies, a matrimonial property dissolution takes place in which the property is divided between the spouses. In particular the assets which the spouses have earned together during the marriage, are divided equally between the spouses. This means that one half is credited to the surviving spouse, while the other half is for the benefit of the heirs of the deceased spouse. However, the spouses may agree in a marriage contract that in the event of the death of one spouse, the full amount shall be allocated to the surviving spouse.

In an inheritance contract, the surviving spouse can be favored either by placing the descendants on the compulsory portion and thus the surviving spouse receives more, or the surviving spouse receives the usufruct on three quarters of the inheritance and one as unrestricted property with full ownership.
